TERMS OF SERVICE
Last updated: 20 October 2026
BTT Partners Pty Ltd · ABN 47 667 849 961
These terms explain how Fitness Funnel works with you and how you can use our website. We’ve kept them in plain English. If anything is unclear, email us at hello@fitnessfunnel.com.au.
1. Who we are
Fitness Funnel is a trading name of BTT Partners Pty Ltd, ABN 47 667 849 961, part of CMO Group (“Fitness Funnel”, “we”, “us”, “our”). “You” means the business that signs up for our services or uses our website.
By signing up for a programme or using our website, you agree to these terms.
2. Our services
We provide marketing services for gyms and health businesses through our programmes, currently Member Engine (paid advertising) and the Organic Growth Programme (SEO and content). What’s included in each programme and tier is listed on our Pricing page, or in any written proposal we give you. If a proposal and the Pricing page differ, the proposal applies.
We’ll provide our services with due care and skill, and in a timely way. We’ll communicate with you clearly about what we’re doing and why.
3. Subscriptions
Our programmes are weekly subscriptions with no minimum term and no lock-in contract. Your subscription starts on the date of your first payment and continues week to week until you or we end it under section 11.
You can move up or down a tier at any time. Changes take effect from your next billing week.
4. Fees, billing and payment
• Fees are charged weekly, in advance, through our payment provider, Stripe. All prices exclude GST, which is added to each payment.
• You authorise us to charge your nominated payment method each week while your subscription is active.
• Bundle pricing: the discounted Organic Growth price applies only while you also hold an active Member Engine subscription at the same tier or lower. If your Member Engine subscription ends, or your Organic Growth tier falls below your Member Engine tier, your Organic Growth subscription moves to the standalone price from your next billing week. We’ll tell you before this happens.
• Failed payments: if a payment fails, we’ll let you know and retry it. If the payment is still outstanding 7 days later, we may pause work, including your ad campaigns, until it’s paid. If it remains unpaid for 14 days, we may end your subscription.
• Price changes: we may change our prices by giving you at least 30 days’ written notice. If you don’t want to continue at the new price, you can cancel before it takes effect.
5. Ad spend and third-party platforms
• Ad spend is separate from our fees. You pay your advertising budget directly to the platforms, such as Meta and Google, through your own ad accounts. Each Member Engine tier has a minimum daily ad spend, listed on our Pricing page.
• We run your campaigns on platforms we don’t own or control, including Meta, Google, Stripe and Go High Level. Their rules, prices, approval decisions and outages are outside our control. We’re not responsible if a platform rejects an ad, restricts or suspends an account, or changes how it works. If that happens, we’ll work with you to resolve it.
• You agree to follow each platform’s terms and policies for any account used for your campaigns.
6. Your responsibilities
To get the best results, we need you to:
• give us accurate information about your business, offers and pricing
• give us access to the accounts we need, such as ad accounts, your Google Business Profile and website, and keep that access in place while we work together
• review and approve ads, offers and content within a reasonable time
• make sure the offers and claims we advertise for you are true and that you can honour them
• make sure you have the right to use any content you give us, such as photos, videos, logos and testimonials, including permission from any members who appear in them
• follow up the leads we send you promptly, and look after them under privacy and spam laws
If delays on your side hold up our work, we’ll let you know. Your weekly fee continues while your subscription is active.
7. Who owns what
We build everything under your brand, and it’s yours to keep.
• You own: your ad accounts, your ad creative, landing pages, written content and social posts made for you, and your lead and customer data. Ownership passes to you once the relevant week has been paid for.
• We own: our own methods, templates, frameworks, software setups and know-how that we use across clients. We grant you a licence to keep using anything of ours that’s built into your materials.
• Go High Level automations: we run your lead follow-up in our Go High Level account. If you leave, we’ll export your contacts and lead data to you. On request, we’ll help you move your automations into your own Go High Level account.
• We may show work we’ve created for you in our portfolio and case studies, unless you ask us in writing not to. We’ll always ask before naming your results or using your testimonials.
8. Results
We work hard to grow your membership, and we report honestly on how your campaigns are going. But marketing results depend on many things outside our control. These include your offer, pricing, location, competition, how quickly leads are followed up, the experience members have at your gym, and decisions by advertising platforms.
For those reasons, we don’t guarantee any particular number of leads, members or revenue. Any results or averages we share, such as on our website or in case studies, describe past results. They don’t promise what you’ll achieve.
9. Confidentiality and privacy
We’ll keep your business information confidential and only use it to provide our services to you, unless you agree otherwise or the law requires us to disclose it. We ask you to treat our pricing proposals, methods and materials the same way.
We handle personal information, including your leads’ details, in line with the Privacy Act 1988 (Cth) and our Privacy Policy.
10. Our liability
Nothing in these terms excludes, restricts or changes any rights you have under the Australian Consumer Law or any other law that can’t be excluded.
Where the law allows us to limit our liability for failing to meet a consumer guarantee, our liability is limited to supplying the services again or paying the cost of having them supplied again.
Apart from that, and to the extent permitted by law:
• our total liability to you for any claim connected with our services is limited to the fees you paid us in the 12 weeks before the claim arose
• we’re not liable for indirect or consequential loss, such as lost profits or lost opportunities
• we’re not liable for loss caused by third-party platforms, or by anything you or your staff do or fail to do
These limits don’t apply to liability for fraud, wilful misconduct or anything else the law doesn’t allow us to limit.
11. Cancelling and ending our work together
• You can cancel any time. Email hello@fitnessfunnel.com.au or cancel through your Stripe billing link. Your subscription stops at the end of the week you’ve already paid for, and you won’t be charged again. We don’t refund part-weeks, except where the law requires it.
• We can end your subscription by giving you 14 days’ written notice, for any reason. We can end it sooner if you don’t pay (see section 4), seriously or repeatedly breach these terms, or ask us to do something unlawful or that breaches a platform’s policies.
• When we stop working together, we’ll stop running and managing your campaigns. We’ll make sure you keep full access to your ad accounts and everything you own under section 7. We’ll also export your lead and contact data to you within 14 days of a request. Any fees owing up to the end date still need to be paid.
12. Using our website
The content on fitnessfunnel.com.au, including articles and guides, is general information only and isn’t advice for your specific business. You’re welcome to read and share it, but you can’t copy or republish it as your own without our permission.
Our website may link to other websites. We’re not responsible for their content or how they handle your information.
13. Changes to these terms
We may update these terms from time to time. If a change affects active clients, we’ll email you at least 30 days before it takes effect. If you don’t agree with the change, you can cancel before then. The latest version will always be on this page.
14. General
• These terms are governed by the laws of [State], Australia, and the courts of that state have jurisdiction.
• If there’s a disagreement, we’ll both try to sort it out in good faith by talking first, before taking any formal action.
• If any part of these terms can’t be enforced, the rest still applies.
• If we don’t enforce a right straight away, we haven’t given it up.
